November 26th to November 27th, the third Cross-strait Free Trade Law Forum was held at Soochow University Kenneth Wang School of Law. Prof. Zheng Shaohua, Assistant President of Shanghai University of Finance & Economics (hereinafter referred to as “SUFE”), Prof. Song Xiaoyan, Associate Dean of SUFE Law School (stewardship), Prof. Hu Ling, Vice President of SUFE Law School, and Dr. Su Pan, attended the meeting.

 

 

 

 

The opening ceremony was presided by Prof. Fang Xinjun, Vice Dean of Kenneth Wang School of Law of Soochow University. Prof. Hong Jiayin, Dean of Law School of Taiwan Soochow University, Prof. Zheng Shaohua, Assistant President of SUFE, and Prof. Hu Yuhong, President of Soochow University Kenneth Wang School of Law made a speech respectively. Professor Hong Jiayin expounded the guiding role of academic research in policy formulation. Professor Zheng Shaohua believed that the "1 + 3 + 7" model of free trade area is an important part of social economic rule of law, and Cross-strait Free Trade Forum will help promote the development of free trade zone. Professor Hu Yuhong believed that this conference, in conjunction with scientific research, will contribute to the research on the rule of law in free trade, which is conducive to sublimating scientific research achievements, strengthening the power of scientific research, consolidating scientific research achievements and summing up experiences across the country, in order to explore the road suitable for our own situation.

 

 

The meeting consists of four modules. First of all, Prof. Song Xiaoyan of SUFE Law School made a speech on "The Free Trade Area (FTA): Challenges, Breakthroughs and Legal Challenges of China's Financial Reform". It analyzed the necessity of China's financial reform from the macroeconomic situation and compared the contents of financial reform between different FTAs, where she pointed out the legal difficulties from the legal aspect that China's financial development should pay attention to and break through; Professor Zheng Shaohua made a comment in the review session that the efficiency of FT account used in the financial reform is not high, the external vitality has its pros and cons, and brought up the idea whether the “Sandbox Model” can be learnt to filter out these unfavorable factors. In addition, Professor Song Xiaoyan presided over the "Finance and Supervision on Free Trade Zone" unit; Associate Professor Hu Ling presided over the “Free Trade and Dispute Settlement Mechanism" unit; Dr. Su Pan made speech on "Legal Supervision on Commercial Bank Loan Linkage Mechanism".

 

 

Except for our university, more than 40 experts and scholars from Taiwa Soochow University, Shanghai University of International Business and Economics, Shanghai International Studies University, Southeast University, Nanjing Normal University, Nanjing University of Finance & Economics, JiangSu Provincial Academy of Social Sciences, Yangzhou University, Sichuan University, Sichuan University of Science & Engineering, China Council for the Promotion of International Trade Suzhou Committee, and Soochow University participated in this forum, and developed academic exchange on many topics such as the function orientation of the FTA’s reform, re-evolution of the financial legal system regarding free trade, the establishment of Taiwan companies in the FTA, the reform on procedures of arbitration and mediation, as well as the dilemma and its way out of China 's legal system on ascertainment of foreign law under the background of " the Belt and Road " etc.

 

On the closing ceremony of this forum, Professor Chen Lihu of Soochow University made an academic summary. He said that the seminar covers a wide range of academic subjects, involving three aspects, free trade, international public law and civil and commercial law, whose topics had all of theoretical forefront, novelty and practicality at the same time. Professor Hong Jia-yin of Taiwan Soochow University put forward the prospect of the next year’s Cross-strait Free Trade Law Forum. Professor Song Xiaoyan addressed on behalf of our Law School, as the next undertaking organization, to expressed gratitude to the organizers of this forum and invited scholars to participate in the next forum.

 

The Cross-Strait Free Trade Law Forum was held in turn by the Law School of Shanghai University of Finance & Economics, the Law School of Taiwan Soochow University and Kenneth Wang School of Law of Soochow University, which has been successfully held three times and the fourth Forum will be held in our Law School in 2017.
